Disaster, Theft & Vandalism (DTV) Protection Plan Overview

At BoomCo Equipment Rental, we require all customers to maintain physical damage coverage on rented equipment. If you do not carry rental equipment insurance through your business policy, we offer a Disaster, Theft & Vandalism (DTV) Protection Plan to meet our insurance requirements and help protect you from major unexpected losses.

What Is the DTV Protection Plan?

The DTV Protection Plan is a protection waiver offered by BoomCo that provides limited coverage in the event of:

  • Natural disasters (e.g., landslides, hurricanes, floods, earthquakes, hail, wildfires)
  • Theft, with a filed police report and proof of reasonable security measures
  • Vandalism, with a filed police report

This plan helps reduce your financial responsibility if the equipment is damaged or lost due to one of these covered events.


Important: The DTV is not insurance. It is a contractual waiver that provides limited protection for specific occurrences while the equipment is in your possession.

Cost of the DTV Protection Plan

The DTV Plan is billed as a 10% premium added to the rental rate.

Example:

  • Monthly rental rate: $4,000
  • 10% DTV Waiver: $400
  • Total: $4,400/mo + tax

If a Certificate of Insurance is not provided, DTV charges may be applied at a rate up to 15% of the rental amount per contract terms.

Customer Responsibility Under the DTV Plan

If a covered incident occurs, the customer is responsible for:

  • The first $1,000, or
  • An amount equal to three times the four-week rental rate,

whichever is greater, per occurrence, per piece of equipment.

What the DTV Plan Covers

The following events are covered when proper security precautions are taken:

✔ Theft

  • Theft of the rented equipment when reasonable precautions were taken
  • A police report is required

✔ Vandalism

  • Damage from vandalism not caused by negligence
  • A police report is required

✔ Natural Disasters

Examples include:

  • Floods
  • Earthquakes
  • Hurricanes
  • Wildfires
  • Landslides
  • Hail
  • Other natural events outside customer control

What the DTV Plan Does NOT Cover

The plan does not cover damage resulting from improper use, accidents, or any form of operational negligence. Exclusions include, but are not limited to:

✘ Accidental damage or operator error

Includes tip-overs, collisions, improper operation, or incorrect setup.

✘ Improper use or overloading

Exceeding rated capacity or using the machine outside intended purpose.

✘ Failure to maintain or secure equipment

Examples:

  • Not securing equipment during transport
  • Leaving equipment in an unsecured area
  • Not maintaining oil, fluids, fuel, hydraulic levels, or lubrication

✘ Electrical damage caused by power surges

✘ Tires and tubes

✘ Theft of accessories or small items

✘ Intentional abuse or neglect

✘ Equipment in possession of third parties

✘ Damage while violating rental agreement terms or any law

Waiver Exceptions (Gross Negligence)

Even if the customer purchases the DTV Plan, gross negligence is never covered. Examples include:

  • Reckless or abusive operation
  • Intentional damage
  • Use of equipment in a dangerous or improper manner
  • Allowing unauthorized or untrained persons to operate equipment

In cases of gross negligence, the customer remains fully responsible for all damages.

Insurance Option Instead of DTV

Customers may choose not to purchase the DTV Plan if they provide a valid Certificate of Insurance that includes:

  • BoomCo Equipment Rental named as Additional Insured
  • Waiver of Subrogation (WOS)
  • Primary & Non-Contributory (PNC) language
  • Minimum coverage limits: $1M / $2M
  • Property/Equipment coverage sufficient to cover the full replacement value of rented equipment

If insurance is not provided, the DTV Plan will be applied.

Subrogation Requirement

In the event of a loss, BoomCo may pursue recovery from responsible parties. Customers must:

  • Cooperate fully
  • Provide required documents
  • Avoid any actions that impede BoomCo’s ability to recover damages
